The ACCC is holding a public inquiry under Part 25 of the Telecommunications Act 1997 into making a final access determination for the superfast broadband access service (SBAS).

The inquiry will consider the terms and conditions of access to the SBAS including prices for the service and non-price terms and conditions.

The ACCC intends to publish a discussion paper for the inquiry later this year and seek written submissions on matters raised in the paper which will include:

  • options for determining SBAS prices
  • whether regulated prices are required for lower speed broadband products (e.g. 12Mbps) provided through the SBAS
  • a potential competition-based exemption framework to the standard access obligations applicable to the SBAS.

The time for making submissions will be a minimum of 28 days from the date of the discussion paper.

Submissions can be made in writing to superfastbroadbandinquiry@accc.gov.au, or as otherwise directed in the discussion paper.

We anticipate that this inquiry will be conducted over a 12-month period. The ACCC has set interim price and non-price terms and while it completes this inquiry.
