The ACCC held a public inquiry under Part 25 of the Telecommunications Act 1997 into making a final access determination for the superfast broadband access service (SBAS).
The inquiry considered the terms and conditions of access to the SBAS including prices for the service and non-price terms and conditions.
The ACCC intends to publish a discussion paper for the inquiry later this year and seek written submissions on matters raised in the paper which will include:
- options for determining SBAS prices
- whether regulated prices are required for lower speed broadband products (e.g. 12Mbps) provided through the SBAS
- a potential competition-based exemption framework to the standard access obligations applicable to the SBAS.
The time for making submissions was a minimum of 28 days from the date of the discussion paper.
We anticipate that this inquiry will be conducted over a 12-month period. The ACCC has set interim price and non-price terms and while it completes this inquiry.
