Submission to Treasury Exposure draft
On 14 January 2022, the ACCC made a submission to the Exposure draft seeking to improve the timeliness of the National Access Regime. The submission outlines the general support for the reforms, but highlights the ACCC’s concerns with leaving merits review in the regime for access determinations given it is being removed for declarations.

Submission to Treasury consultation paper
On 19 April 2021, the ACCC made a submission to a consultation by Treasury on the timeliness of the National Access Regime (Part IIIA of the Competition and Consumer Act 2010). The submission covers the consultation topics of merits review, repeat applications and arbitration determinations. It also advocates broader reform so that the regime can effectively cover monopoly pricing.

Independent Consultation on the Phase out of Live Sheep Exports by Sea
In March 2023, the Minister for Agriculture, Fisheries and Forestry, Senator the Hon Murray Watt appointed an Independent Panel in March 2023 to consult and provide advice on how and when a phase out of live sheep exports by sea could be implemented. On 15 June 2023, the ACCC made a submission to the Independent Panel’s consultation paper regarding the phase out.

On 13 September 2018, the ACCC made a submission to a consultation by the Department of Agriculture and Water Resources on Streamlining Regulation of Agricultural and Veterinary Chemicals. Productivity Commission 2011 inquiry
In December 2010 the Australian Government referred the current economic regulation arrangements for airport services to the Productivity Commission for inquiry and report. The Productivity Commission released an issues paper on 25 January 2011.

The ACCC provided its initial submission to the Productivity Commission on 21 March 2011. The Productivity Commission released its draft report on 22 August 2011. The ACCC made a further submission to the inquiry on 10 October 2011.

Harper Review of Competition Policy 2014
The Australian Government has initiated a comprehensive review of Australia’s competition laws and policy (the “Harper Review”) —the first in more than 20 years. The competition policy review panel, established by the Government, released an issues paper on 14 April 2014.

In June 2014, the ACCC provided its submission in response to the issues paper. The ACCC provided a submission in response to the Draft Report on 26 November 2014.

The ACCC provided a submission to the Government’s public consultation on the Final Report on 29 May 2015. In October 2016, the ACCC made a submission on the changes the Government proposes to make to the CCA following the Harper Review.

In January 2017, the ACCC made a submission to the Economics Legislation Committee’s inquiry into the Competition and Consumer Amendment (Misuse of Market Power) Bill 2016.

2024 Regional Telecommunications Review
In July 2024, the ACCC made a submission to the Regional Telecommunications Independent Review Committee (RTIRC) in response to its consultation on the 2024 Regional Telecommunications Review Issues Paper.

On 20 May 2024 Communications Alliance Ltd provided the ACCC with the TCP Code Drafting Committee’s substantive draft, seeking the ACCC’s feedback.

On 17 November 2023 Communications Alliance Ltd provided the ACCC with a package of papers prepared by the TCP Code Drafting Committee, seeking the ACCC’s feedback.

The ACCC provided its response to the 17 November 2023 package of papers in January 2024.

On 9 November 2023, the Senate referred the matter to the Environment and Communications References Committee for inquiry and report by 9 December 2023.

The ACCC provided a submission in response to the terms of reference on Friday, 17 November 2023.

Review of the Telecommunications Consumer Protections Code
On 20 June 2023, the ACCC made a submission to the Telecommunications Consumer Protections Code 2024 Review Discussion Paper. The submission sets out the ACCC’s position on telecommunication consumer protections priorities that should be incorporated into the code, as well as advocating for a stronger consumer safeguards regulatory framework to reflect the essential nature of telecommunications services.

The submission was submitted to Consumer Alliance Ltd., the primary communications industry body in Australia.

In September 2021, the ACCC made a submission to the Australian Communications and Media Authority’s consultation on its draft Statement of Expectations for the telecommunications industry on consumer vulnerability.

In September 2020, the ACCC made a submission to the Department of Infrastructure, Transport, Regional Development and Communications in response to its consultation paper for Part C of the Consumer Safeguards Review.

Telecommunications in New Developments policy
In June 2020 the ACCC made a submission to the Department of Infrastructure, Transport, Regional Development and Communications in response its consultation on the draft Telecommunications in New Developments (TIND) policy.

ACCC advice to the Minister for Communications on Exemption Extension Requests – Telstra’s South Brisbane and Velocity Estate networks and TPG’s upgraded VDSL and very small scale networks
In May 2020, the Minister for Communications, Cyber Safety and the Arts requested the ACCC’s advice on requests by Telstra and TPG for extensions to their exemptions from the default structural separation requirements in Parts 7 and 8 of the Telecommunications Act 1997. The ACCC provided advice on this matter in June 2020. Commercially sensitive information has been redacted in the copy of the advice published here.

NBN Migration Assurance Policy
In August 2015 the ACCC made a submission on the draft policy of the Department of Communications that is designed to facilitate an improved experience for consumers migrating to the NBN.

Convergence review
The Convergence Review was an independent review established by the Australian Government in 2010 to examine the policy and regulatory frameworks that apply to the media and communications sectors. The final report of the review was released in April 2012.

Workplace Gender Equality Act 2012 review
On 26 November 2021, the ACCC made a submission to the Department of the Prime Minister and Cabinet’s review of the Workplace Gender Equality Act 2012. The ACCC is committed to gender equality and diversity. On 5 December 2022, Treasury released a consultation paper to inform the review’s assessment of the effectiveness of the dispute resolution provisions.

The Senate Environment and Communications Legislation Committee Inquiry into the Competition and Consumer Amendment (Prevention of Exploitation of Indigenous Cultural Expressions) Bill 2019
In 2019 the Senate referred the Competition and Consumer Amendment (Prevention of Exploitation of Indigenous Cultural Expressions) Bill 2019 to the Environment and Communications Legislation Committee. This Bill proposed to make it an offence to supply or offer commercial goods to a consumer that include Indigenous cultural expression unless supplied by, or in accordance with a transparent arrangement with, an Indigenous artist or relevant Indigenous community. In July 2019 the ACCC made a submission to the Committee’s inquiry into the Bill.

On 22 January 2021 the ACCC made a submission to the National Transport Commission in response to its discussion paper on a national in-service safety law for automated vehicles.

Therapeutic Goods Administration interim decision on nicotine scheduling
On 23 September 2020 the Therapeutic Goods Administration (TGA) announced an interim decision on its proposal to amend the scheduling of nicotine in the Poisons Standard. The interim decision proposed to reschedule nicotine for human use in products such as electronic cigarettes, while retaining exemptions for tobacco prepared for smoking and registered smoking cessation products. The ACCC made a submission to the TGA in response to the interim decision on 12 November 2020.

Austroads Motorised Mobility Devices consultation
On 30 September 2019 the ACCC made a submission to Austroads in response to its Motorised Mobility Devices Discussion Paper: Establishing a Nationally Consistent Framework and Adopting Technical Specification 3695.3.2018. The discussion paper sought input on the proposed adoption of the Technical Specification for Motorised Mobility Devices developed by Standards Australia as a possible means of establishing a nationally consistent framework for powered wheelchairs and mobility scooters.

Standards Australia consultation on its Distribution and Licensing Policy Framework
On 21 August 2019, the ACCC made a submission to Standards Australia in response to its Distribution and Licensing Policy Framework discussion paper. The discussion paper sought input from stakeholders on the design of Standards Australia’s distribution model to deliver greater reach and access to Standards Australia content.

On 8 April 2019, the ACCC made a submission to the Department of Health consultation on the Review of Tobacco Control Legislation. This consultation sought input from stakeholders on a thematic review of tobacco control legislation in Australia.

Review of the Asbestos Safety and Eradication Agency
On 21 February 2019, the ACCC made a submission to the five year review of the Asbestos Safety and Eradication Agency (ASEA), an independent statutory authority established by the Asbestos Safety and Eradication Agency Act 2013. ASEA administers the National Strategic Plan for Asbestos Management and Awareness, to prevent exposure to asbestos fibres and to assist in the elimination of asbestos-related disease in Australia.

Department of Agriculture and Water Resources consultation on Agricultural and Veterinary Chemicals
On 21 February 2019, the ACCC made a submission to the Department of Agriculture and Water Resources consultation on the proposal to deregulate certain agricultural and veterinary chemicals. The submission comments on the exposure draft of the Agricultural and Veterinary Chemicals Legislation Amendment (Timeshift Applications and Other Measures) Regulations 2018.

Motor Vehicle Standards Act (MVSA) Review
On 13 December 2017 the Department of Infrastructure, Regional Development and Cities (DIRDaC) released its exposure draft of the Road Vehicle Standards package of legislation. This package included the draft Road Vehicle Standards Bill 2018 (the Bill), the Explanatory Memorandum to the Road Vehicle Standards Bill 2018 and the Road Vehicle Standards Rules 2017 (the Rules) which, if passed, would replace the current Motor Vehicle Standards Act 1989 and its subordinate legislation. The ACCC made a submission to DIRDaC in response to the package of legislation on 15 March 2018.

Inquiry into the Use and Marketing of Electronic Cigarettes and Personal Vaporisers
Following a referral on 25 May 2017 from the Minister for Health and Sport, The Hon Greg Hunt MP; the House of Representatives Standing Committee on Health, Aged Care and Sport commenced an inquiry into the marketing and use of e-cigarettes and personal vaporisers in Australia. The ACCC made a submission in response to the inquiry’s terms of reference on 3 July 2017.

On 21 June 2017 the ACCC made a submission to the Queensland Public Works and Utility Committee in response to the Committee’s call for submissions on the proposed Building and Construction Legislation (Non-conforming Building Products – Chain of Responsibility and Other Matters) Amendment Bill 2017.

Therapeutic Goods Administration’s consultation on options for the future regulation of 'low risk' products
On 31 March 2017, the Therapeutic Goods Administration (TGA) released a consultation paper on options for the future regulation of ‘low risk’ products, including deregulation of certain classes of products. The paper noted the relationship between the Australian Consumer Law and therapeutic goods legislation. The ACCC made a submission on 18 May 2017 in response to the TGA’s request for comment.

On 6 December 2023, the Senate resolved that the Select Committee on Supermarket Prices be established to inquire into and report on the price setting practice and market power of major supermarkets. In February 2024, the ACCC made a submission in response to the Senate Select Committee on Supermarket Prices' Inquiry.
