The Competition and Consumer (Gas Market Code) Regulations 2023 commenced on 11 July 2023.
Certain sections of the Gas Market Code give the ACCC the power to make determinations including for recording keeping and reporting requirements.
On 15 November 2023, the ACCC released its proposed determinations in regards to suppliers’ record keeping, publishing and reporting obligations under the Gas Market Code. The proposed determinations are in regards to sections 33(3), 34(3), 34(7) and 35(3) of the Gas Market Code.
The ACCC invited submissions in response to its proposed determinations. Submissions closed on Wednesday 6 December 2023.
On 20 December 2023, the ACCC's final determinations were registered on the Federal Register of Legislation. The determinations were made by legislative instrument.
