Summary

Aplication for authorisation by AHA (NSW) to engage in collective negotiations and collective boycotts in dealings with Tab Ltd in relation to the provision of PubTAB and Sky Channel in relation to the provision of pay television services. On 23 May 2003, the Applicants advised they no longer seek authorisation in respect of collective boycott activity.

The Commission grants authorisation to application A90837 for a period of five years. Authorisation extends to voluntary collective bargaining on behalf of AHA NSW members in relation to the provision of wagering services and with Sky Channel in relation to the provision of racing broadcast services. The authorisation extends to the making and giving effect to the provisions of agreements that are collectively negotiated between AHA NSW members and Tab Limited and Sky Channel. The authorisation does not extend to any collective bargaining arrangement whereby AHA NSW members are compelled to participate in a bargaining group. The authorisation in no way allows collective boycott activity or any other conduct which may constitute an exclusionary provision as defined under section 4D of the Act.
