What the ACCC does

  • We accept and record your information about business practices and behaviours that are concerning to you.
  • We respond to your report where we have information that might help you.
  • We use the information you share to help us address conduct causing harm for small businesses in Australia.

What the ACCC can't do

  • We don’t act on your behalf or provide you with legal advice on your rights and obligations under the law.
  • We don’t make formal decisions on whether a business or person has breached a law. Only a court can do this.
  • We don’t provide dispute resolution services. Other agencies can help with this.

Steps in the reporting process

  1. Tell us about your experience

    Tell us about your small business issue and who or what you’re having problems with.

  2. We’ll read through your report

    In most cases you won’t hear from us after submitting your report. We’ll be in touch if you’ve asked for help clarifying your rights or obligations under the law, or we need more information from you.

  3. We’ll use your story to understand what market issues are causing the most harm to small businesses

    The information you share becomes part of our knowledge base about small business. We use this knowledge to address issues that will have the greatest benefit for small businesses.

    Our Privacy Policy sets out what we will do with your information.

While making a report to the ACCC helps us provide greater benefit to consumers and small business, unfortunately we can’t use it to help you resolve your individual issue with another business.

Consider approaching the business or person and asking them to fix the problem

Before you make a report to the ACCC, you should consider whether the issue could be resolved directly with the business or person. If this is the case, we have resources to help you write an effective complaint letter.

There are also other agencies that may be able to help you to resolve a dispute.

Or you can continue to make a report. If you’re making a report keep in mind we won’t be able to take any action on your behalf.

Instead, we’ll listen to your issue and use this information to inform positive change that broadly benefits small business and the market.
