The ACCC undertakes a biannual collection and analysis of internet activity data through a new Internet Activity record keeping rule, under section 151BU of the Competition and Consumer Act 2010, from the December 2018 reporting period onwards.
The ACCC made the Audit of Telecommunications Infrastructure Assets record keeping rule in December 2007. The record keeping rule requires specified carriers to report on the locations of their core network and customer access network (CAN) infrastructure.
The Competition and Consumer (Gas Market Code) Regulations 2023 commenced on 11 July 2023. Certain sections of the code give the ACCC the power to make determinations including for recording keeping and reporting requirements.
On 13 December 2013 the ACCC accepted NBN Co's Special Access Undertaking (SAU). The SAU commenced on 13 December 2013 and will expire in 2040.
On 10 October 2022 the ACCC sent a letter to ARTC regarding the potential timing of assessing a replacement undertaking. On 19 December 2022 ARTC provided a letter to stakeholders outlining its intent to submit a new 2023 IAU and a further extension of the 2008 IAU in early 2023.
On 23 April 2020, the ACCC engaged GHD to conduct a Depreciated Optimised Replacement Cost (DORC) valuation of ARTC's Interstate network to determine the Regulated Asset Base (RAB).
Under section 2.2(b) of the 2008 Interstate Access Undertaking (IAU), ARTC must submit to the ACCC a written statement outlining whether or not it intends to submit a new undertaking to the ACCC for its consideration, no later than six months prior to the expiry of the 2008 IAU. ARTC’s 2008 IAU was due to expire on 30 June 2020.
On 23 August 2019, ARTC sent a letter to the ACCC seeking views on ARTC's proposal to revalue the Regulated Asset Base (RAB) on the Interstate network using the Depreciated Optimised Replacement Cost (DORC) methodology. ARTC stated it was seeking views on this proposal prior to formally submitting its replacement Interstate Access Undertaking application for ACCC assessment.
The ACCC considered potential competition issues associated with the use and implementation of e-SIMs in Australia in our Communications sector market study, which concluded in April 2018.
On 18 February 2019, the ACCC commenced a public consultation on its intention to undertake collection and analysis of competitive supply and pricing data for the Dark Fibre and NBN Wholesale Aggregation Services via new record keeping rule.
