Background
The ACCC made the Audit of Telecommunications Infrastructure Assets record keeping rules in December 2007. The record keeping rule requires specified carriers to report on the locations of their core network and customer access network (CAN) infrastructure.
In February 2011 the ACCC published a list of exchange service areas (ESAs) with more than two fibre infrastructure owners based on information collected under the Infrastructure record keeping rule.
In March 2013 the ACCC amended the Infrastructure record keeping rule to update the list of record keepers and seek information on leased infrastructure and infrastructure operated on behalf of third parties.
In December 2017 the ACCC amended the Infrastructure record keeping rule to further update the list of record-keepers and clarify the information to be reported on mobile and fibre to the building infrastructure and the geographic areas for customer access networks.
On 21 November 2019 the ACCC released a consultation paper seeking views on amending the record keeping rule to update the list of record keepers and change the requirements for reporting of mobile network infrastructure.
On 20 October 2021 the ACCC released a consultation paper seeking stakeholders’ views on updating the list of record-keepers, and introducing new reporting requirements in relation to end-user equipment and mobile infrastructure. The consultation paper also seeks comments on amendments to the rules to ensure that record-keepers provide detailed references to all elements in maps, and advise the ACCC of any changes in the methodology they have adopted in the preparing their reports.
On 30 November 2022, in light of the Telstra legal restructure, the ACCC released a public consultation paper on proposed amendment to the Telstra Customer Access Network record keeping rule, the Division 12 record keeping rule, the Audit of telecommunications infrastructure record keeping rule, and the Internet Activity record keeping rule, as well as the final access determinations Nos. 1 to 7 of 2019 for Fixed Line Services and the interim access determination No. 1 of 2021 (SBAS).
On 15 November 2023, in light of changes to participants in the market, the ACCC released a consultation paper seeking stakeholder views on proposed amendments to the list of record keepers in the Internet Activity and Audit of telecommunications infrastructure record keeping rules. The ACCC published a final decision on 20 December 2023.
