The ACCC has granted interim authorisation to Campbelltown City Council, Camden Council, Liverpool City Council, Wingecarribee Shire Council and Wollondilly Shire Council to commence preparations for a collective tender process for waste processing services.  No contracts will be entered into under interim authorisation.

Interim authorisation commences immediately and remains in place unless it is revoked by the ACCC or the when the ACCC completes its assessment of the application for authorisation.

Interim authorisation effectively provides a legal exemption; the councils may be considered to be each other’s competitors in procuring these services, and therefore engaging in joint procurement may breach competition laws unless authorised.
