Planet Earth Design Concepts Pty Ltd - s.87B undertaking

The ACCC investigated Planet Earth Design Concepts Pty Ltd ('Planet Earth'), trading as Churinga Designs, in relation to conduct which the Commission alleged was in breach of the resale price maintenance provisions of the Trade Practices Act 1974.

An Undertaking was received, where Planet Earth has agreed to:

• Not engage in the practice of resale price maintenance, nor withhold supply from the complainant without first informing her in writing of the reasons for the decision;
• Within two weeks of the undertaking taking effect, send letters (in terms of the letter contained in the schedule to the undertaking) and enclose a copy of the Undertaking to each person to whom it currently supplies products; and Implement a trade practices compliance program and complaints handling system.
