A Dealer Programme was implemented by Kong under which retailers supplied by Kong would promote Hydor products. It was a condition that retailers observe set minimum prices in relation to certain of these products. Kongs admitted breach of section 48 and the Commission accepted that no breach of section 45A had occurred. The compliance programme involves generally educating staff and retailers about the Trade Practices Act.
