The ACCC did not consider it necessary to form a definitive view on the relevant markets as the outcome of the competition analysis was considered likely to be the same regardless of whether a broader or narrower telecommunications services market was adopted.

Competition analysis

The ACCC considered that the proposed acquisition would be unlikely to result in a substantial lessening of competition for the supply of fixed voice, mobile or data services, including to small and medium enterprises, given that the merged firm is expected to be constrained by Telstra and Optus and, to a lesser extent, by the numerous smaller competitors that can offer a similar service.
