Summary

On 7 September 2023, the Australian Competition and Consumer Commission (ACCC) granted Discover Energy Pty Ltd (Discover Energy) an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) from specific consumer data sharing obligations under Part 1 and all of Part 4 of the Competition and Consumer (Consumer Data Right) Rules 2020 (CDR Rules). It is a condition of the exemption that Discover Energy notify the ACCC in writing, within 5 Business Days, of any of the following events occurring: (1) Discover Energy’s customer numbers reach 10,000 small customers, or (2) Discover Energy makes an application to become an accredited person under rule 5.2 of the CDR Rules. It is also a condition of the exemption that Discover Energy provides a notification to the ACCC if it wishes to participate as a data holder in Part 4 of the CDR Rules on and from a specified date. The ACCC granted the exemption in response to an application from Discover Energy.
