implement a trade practices compliance program; and
publish a corrective notice in newspapers as well as at both service stations.

Patterson Cheney Pty Ltd, trading as Patterson Cheney Holden (Patterson Cheney) has provided a court enforceable undertaking to the ACCC following an investigation relating to a breach of the Trade Practices Act 1974.
Patterson Cheney admits that it engaged in misleading conduct in contravention of section 53(g) of the Trade Practices Act 1974 when it advertised a Lifetime Mechanical Warranty which was subject to significant limitations.
The undertaking requires Patterson Cheney to:
send a letter to all of its customers who purchased a vehicle to which the Lifetime Mechanical Warranty applied and inform them that they have the option to switch to Patterson Cheney's Premium warranty product;
publish corrective notices on its website and in The Herald Sun and The Age; and
establish a trade practices compliance program.
Withdrawal of Section 87B Undertaking
On 8 March 2011 the ACCC consented to the withdrawal of the Undertaking of Mr Mark Rowsthorn, previously accepted on 18 April 2007 (Undertaking).
The purpose of the Undertaking was to establish and maintain Mr Mark Rowsthorn's independence, as a director of Asciano, from Toll.
Under the Undertaking, Mr Mark Rowsthorn agreed to remain an 'Independent Asciano Person'.
Dragon Alliance South Pacific Pty Ltd (Dragon) has provided a court enforceable undertaking to the ACCC following an investigation relating to a breach of the Trade Practices Act 1974.
Dragon admits that it engaged in resale price maintenance.
The undertaking requires Dragon to:
cease providing its current online trading agreement to its online traders and replace it with an updated online trading agreement;
send a letter to all online Dragon retailers notifying them of the undertaking and -informing them that they can choose the minimum selling price of Dragon products; and
establish and implement a Trade Practices Compliance program.
Galdan Investments Pty Ltd trading as Tropic Banana Company has provided a court enforceable undertaking to the ACCC in response to concerns over its conduct regarding trade in horticulture produce.
The undertaking acknowledges that from 14 May 2007, Galdan conducted trade in horticulture produce without:
having horticulture produce agreements in place when they traded with growers of horticulture produce;
preparing, publishing and making publicly available a document setting out the terms and conditions on which they would trade in horticulture produce with growers; and
giving growers the required statements for the reporting periods.
Galdan acknowledges that its conduct is likely to have been in breach of the Horticulture Code of Conduct (the Code), a mandatory industry code under, at the time, the Trade Practices Act 1974 and as of 1 January 2011, the Competition and Consumer Act 2010.
As part of the undertaking accepted by the ACCC, Galdan will:
only trade in horticulture produce with growers where a horticulture produce agreement is in place;
prepare, publish and make publicly available the terms and conditions under which it will trade with growers of horticulture produce;
provide statements to each of its growers for the reporting periods;
arrange trade practices compliance training for its relevant staff;
arrange for the production of a DVD containing a presentation outlining the effect and operation of the Code and to provide a copy of that DVD to all growers with whom it has traded since 14 May 2007, without charge; and
publish an information notice in the Queensland Country Life newspaper.
Jewellery wholesaler Global Enterprises (Qld) Pty Ltd, trading as Allure Gold has provided a court enforceable undertaking to the ACCC following an investigation relating to a number of breaches of the Trade Practices Act 1974.
