Summary
On 17 October 2023, Envirospheres Pty Ltd (Envirospheres) lodged an exclusive dealing notification with the ACCC.
Envirospheres is an Australian company which harvests, processes and supplies cenospheres, marketed as microspheres. In 2017, Envirospheres and Stanwell (a Queensland Government owned corporation with a number of electricity generating assets, including coal-fired power stations) entered into a contract for Envirospheres to acquire cenospheres from defined sources at Stanwell’s coal-burning power plants in south-east Queensland on an exclusive basis.
Envirospheres and Stanwell wish to renew that arrangement, pursuant to a new agreement. The key terms of that arrangement are:
· Envirospheres is the exclusive off-taker of all cenospheres
· The initial term is for 5 years, with an option to extend for 2 years
· The agreement is conditional on the conduct being notified to the ACCC by Envirospheres.
Legal protection provided by an exclusive dealing notification commences immediately when the notification is lodged, and will continue unless or until the notification is revoked or withdrawn.
