Summary
TSG Franchise Management Pty Ltd (TSG) grants third parties the right to operate TSG branded tobacco businesses on terms set out in franchise agreements. Products sold by TSG franchisees include tobacco, tobacco related products and other convenience store products. TSG franchisees are at approximately 470 locations throughout metropolitan and regional areas of Australia.
TSG proposes to negotiate terms of a supply agreement on behalf of TSG Franchisees with British American Tobacco Australia Limited (BATA), for a period of three years. This includes TSG collectively negotiating with BATA on terms relating to rebates and discounts for the supply of tobacco products.
On 19 December 2019, the ACCC decided not to object to the notification. The ACCC decided to allow the immunity provided by the notification to remain in force for ten years from the date it was lodged. Accordingly, the notification came into force on 29 November 2019 and will remain in force until 14 November 2029, unless it is withdrawn or revoked.
