Summary

On 15 March 2019, Ballina Shire, Byron Shire and Richmond Valley Councils (together, the Councils) lodged a collective bargaining notification under which they propose to jointly tender, negotiate and administer contracts with the successful contractor for the receipt and processing of recyclables for their respective local government areas. The Councils requested immunity for six years.

The notification does not include services for the collection of kerbside waste or recyclables.

The conduct notified constitutes collective bargaining under section 93AB of the Competition and Consumer Act 2010. The Councils do not propose to engage in collective boycotts. The expected outcome of the notified conduct is that the Councils will enter separate contracts with one contractor. The contracts would be for three years with the potential for two one year extensions.

On 10 April 2019, the ACCC decided not to object to the notification, and to allow the immunity provided by the notification to remain in force for six years from the date immunity commenced. Accordingly, the notification will remain in force until 29 March 2025, unless it is withdrawn or revoked.
