Description of Conduct

The W.A.T.A.B Agents' Association Incorporated (the Association) is seeking authorisation on behalf of present and
future members, to collectively bargain with Racing and Wagering Western Australia (RWWA*) in relation to the terms
and conditions of the provision of services by Association members to RWWA.
The Association also proposes to represent members in the process for resolving disputes between RWWA and an agent
or agents.
*Or any successor entity which holds the license to conduct off course totalisator activities in Western Australia.
Authorisation has been sought for 10 years.
The Association is also requesting interim authorisation for their members to commence negotiations with RWWA
immediately.
The application has been made under the streamlined process for small business.

On 26 November 2014, the ACCC released a draft determination proposing to grant authorisation for 10 years for the Association to collectively negotiate the terms and conditions of service, on behalf of current and future members with RWWA, and to participate in dispute resolution processes between RWWA and agents.
The ACCC has also granted interim authorisation to allow the Association to commence negotiations with RWWA.

The ACCC is currently seeking submissions from interested parties about the Draft Determination. Submissions can be e-mailed to adjudication@accc.gov.au and should be provided by 10 December 2014.

On 17 December 2014, the ACCC released a final determination granting authorisation until 30 January 2024 for the Association to collectively negotiate the terms and conditions of service, on behalf of current and future members with RWWA, and to participate in dispute resolution processes between RWWA and agents.
