Description of Conduct

The Global TOTE Ltd (GTL) lodged an application for authorisation proposing to enter into and give effect to a number of access agreements between GTL and third party corporate bookmakers operating in Australia. Particularly clause 10.3 of the agreement would restrict payment of rebates to a corporate bookmaker's customers in relation to bets made on their new wholesale Global Tote totalisator product for races and sporting events overseas and in Australia, without prior consent of GTL.

Authorisation was sought for five years.

GTL sought urgent interim authorisation by February 2017.

The ACCC sought submissions by 31 January 2017. Public submissions can be viewed on the pubic register here.

On 12 April 2017, Global Tote wrote to the ACCC to withdraw its applications for authorisation. The applications are therefore no longer under assessment by the ACCC.
