Summary
Queensland Cane Growers Organisation Ltd (Canegrowers) seeks authorisation for the collective bargaining of the terms and conditions of supply of sugarcane and making of cane supply and related contracts between sugarcane growers, processors and sugar marketers. The proposed terms include terms relating to the following matters:
a) harvesting of cane
b) delivering cane to the mill or delivery points
c) transport and handling of cane by the mill
d) acceptance and crushing of cane by the mill
e) payment to growers by the mill owner
f) forward pricing terms
g) essential terms governing the supply of GEI ('grower economic interest') sugar to the GEI sugar marketers
h) capturing the value of the by-products and related products from the sugarcane and
i) any other contracts or arrangements relating to the supply of or processing of sugar cane.
The proposed collective bargaining will be undertaken by local Canegrowers organisations on behalf of their current and future members.
On 15 December 2016 the ACCC issued a draft determination proposing to grant authorisation to the proposed collective bargaining arrangements for ten years.
