Description of Conduct
On 8 September 2021, the State of New South Wales as represented by the Ministry of Health (the Ministry) lodged an application seeking the revocation of authorisation AA1000507 and substitution with AA1000573.
The Ministry on behalf of itself, specified private healthcare providers operating in New South Wales, and all New South Wales public hospitals and other healthcare facilities seeks to negotiate and enter into agreements with each participating private healthcare provider, under which the Ministry will provide funding and those providers will provide resources and services to the overall response to COVID-19 in New South Wales being coordinated by the Ministry.
The Ministry also seeks authorisation on behalf of other private healthcare providers notified to the ACCC from time to time.
On 28 September 2021, the ACCC issued a draft determination proposing to grant reauthorisation and granting interim authorisation.
On 2 December 2021, the ACCC issued a final determination granting authorisation for 18 months, until 24 June 2023.
