Description of Conduct
In August 2011 NBN Co Limited (NBN Co) sought authorisation for particular provisions of an agreement between itself and SingTel Optus Pty Ltd and other Optus entities (Optus) to migrate Optus' hybrid fibre-coaxial cable (HFC) subscribers to the national broadband network.
In January 2012 NBN Co and Optus amended an aspect of this arrangement known as the 'anti-disparagement' provision. As part of this process NBN Co withdrew its August 2011 applications for authorisation (A91271-A91273) and sought authorisation for the amended agreement (A91290-A91292).
