Description of Conduct
On 20 May 2020, the National Lotteries and Newsagents Association Ltd (National Lotteries and Newsagents Association) applied for authorisation to collectively bargain on behalf of its current and future members with Tabcorp Holdings Ltd (Tabcorp). The proposed collective bargaining conduct relates to the terms and conditions applicable to the arrangements between Tabcorp and the National Lotteries and Newsagents Association’s members.
The National Lotteries and Newsagents Association is a national industry body, representing the newsagency and lottery industry. Its sole shareholder is the Victorian Association of Newsagents. Tabcorp was the official Government licensed operator of lottery products in all States and Territories of Australia (except Western Australia). The National Lotteries and Newsagents Association sought authorisation for 5 years and also requested interim authorisation as soon as possible.
On 6 August 2020, the ACCC issued a draft determination proposing to grant authorisation for 5 years. The ACCC also granted interim authorisation to enable the National Lotteries and Newsagents Association to commence the proposed collective bargaining conduct while the ACCC continues its assessment of the application.
On 17 September 2020, the ACCC issued a determination authorising the National Lotteries and Newsagents Association to collectively bargain with Tabcorp until 9 October 2025. The determination is available below.
On 19 January 2024, the National Lotteries and Newsagents Association lodged an application for minor variation to authorisation AA1000515. The National Lotteries and Newsagents Association sought a minor variation to the authorisation to amend parts of the authorised conduct which refer to ‘Tabcorp’ to be altered to refer to ‘The Lottery Corporation Limited’.
On 28 March 2024, the ACCC issued a determination varying the authorisation to replace references to ‘Tabcorp’ in the authorised conduct with ‘The Lottery Corporation Limited.’
Authorisation AA1000515 as varied will remain in effect until 9 October 2025.
