Summary
The Metropolitan Waste and Resource Recovery Group (MWRRG), on behalf of itself and a group of thirty councils located in metropolitan Melbourne, sought to collaboratively investigate, and potentially procure, the provision of sorting services for commingled recyclable material that is collected from residents’ kerbsides.
MWRRG, on behalf of the councils, sought authorisation for:
- MWRRG, on behalf of the councils, to conduct a collaborative competitive tender process for the procurement of the sorting services, evaluate responses in collaboration with the councils and to negotiate on behalf of the councils the contractual framework,
- The possible establishment of a Special Purpose Vehicle (SPV) by the councils to enter into contract(s) for sorting services with the successful supplier(s), and
- The ongoing administration and management of the resulting contracts.

On 25 September 2019, the ACCC granted interim authorisation to enable commencement of the tender process for the joint procurement of the sorting services for recyclable waste.
On 5 December 2019, the ACCC issued a draft determination proposing to grant authorisation for 12 months to conduct the tender process and negotiate and execute contracts, and 20 years to give effect to the contracts for the supply of recyclable waste sorting services. On 14 February 2020, the ACCC decided to issue a determination granting authorisation for 12 months to conduct the tender process and negotiate and execute contracts, and 20 years to give effect to the contracts for the supply of recyclable waste sorting services. If no application for review is lodged to the Australian Competition Tribunal, the ACCC’s determination will come into force on 7 March 2020.
