Description of Conduct

The Metropolitan Waste and Resource Recovery Group (MWRRG), on behalf of itself and a group of sixteen councils located in the south-east of metropolitan Melbourne (the Participating Councils), is seeking to conduct a joint competitive tender process to investigate, and potentially procure, the provision of advanced waste processing services. This may include the construction and operation of one or more facilities for the recovery of value from residual waste.

MWRRG, behalf of the Councils, seeks authorisation for:

  1. MWRRG to conduct a collaborative competitive tender process for the Services, to evaluate the responses in collaboration with the Councils, and to negotiate on behalf of the Councils the contractual framework
  2. a Special Purpose Vehicle (SPV) established by the Councils to enter into contract(s) for the Services with the successful supplier(s) and
  3. ongoing administration and management of the resulting contracts to be undertaken by the SPV

On 29 August 2019, the ACCC granted interim authorisation to enable commencement of the tender and contract negotiation process for the joint procurement of advanced waste processing services.

On 20 November 2019, the ACCC issued a draft determination proposing to grant authorisation. A copy of the draft determination is available from the links below.

On 17 December 2019 the ACCC decided to grant authorisation for 30 months to conduct the tender process and 30 years to give effect to the contract(s) for the supply of advanced waste processing services, until 8 July 2052. A copy of the ACCC’s determination is available from the link below.
