Description of Conduct

On 14 February 2019, five Councils in south-east Queensland (Logan, Ipswich, Redlands, Lockyer Valley and Somerset) lodged an application for authorisation to collectively tender for waste processing services. The services will be limited to the processing or disposal of resources and/or waste and will not include waste collection services or the operation of existing waste transfer stations and tip shops.

The Councils are seeking authorisation until 31 December 2050 to provide a waste stream contract of sufficient length to underwrite investment in a new processing facility in the region. The Councils also sought interim authorisation to commence the tender process, given existing waste processing contracts expire in mid to late 2019.

On 29 March 2019, the ACCC granted interim authorisation to the applicants to enable them to commence an Expression of Interest process for the supply of waste processing services. Interim authorisation remains in force until the ACCC’s final determination takes effect.

On 20 June 2019, the ACCC granted authorisation until 31 December 2050.
