Summary

On 25 May 2021, the Australian Directors’ Guild (ADG) lodged an application on behalf of itself and its current and future members, seeking authorisation for 10 years to collectively negotiate and to create new contracts or arrangements with current and future members of Screen Producers Australia (SPA) that contain model terms of engagement for feature film, television series, and television serials, and give effect to these new contracts or arrangements.

On 13 August 2015, the ACCC granted authorisation A91499 for conduct substantially similar to that for which the ADG now seeks authorisation. This authorisation expired on 4 September 2020.

On 14 July 2021, the ACCC issued a draft determination proposing to grant authorisation, and also granted interim authorisation to enable the ADG and its members to collectively negotiate with SPA and its members while the ACCC completes its assessment of the substantive application.

The ACCC is seeking submissions on the draft determination. An indicative timetable is set out below for your information.
