Summary

On 21 May 2020, the Australia New Zealand Industrial Gas Association (ANZIGA) applied for authorisation on behalf of itself, its members and their related bodies corporate and other suppliers of medical oxygen to hospitals and similar medical facilities in Australia (the Parties) to enable them to exchange information and make and give effect to contracts, arrangements and understandings to ensure security of supply of medical oxygen to hospitals and similar medical facilities during the COVID‑19 pandemic (the Proposed Conduct). ANZIGA seeks authorisation for 12 months from the date of the ACCC’s final determination.

ANZIGA also requested interim authorisation on an urgent basis to ensure that the Parties are able to respond immediately to any significant supply constraint or demand increase for medical oxygen, in the event that this becomes necessary.

On 9 June 2020, the ACCC granted interim authorisation to the Proposed Conduct, subject to conditions which require ANZIGA to notify the ACCC before engaging in the Proposed Conduct, regularly report to the ACCC and provide information to the ACCC upon request.

On 2 September 2020, the ACCC issued a draft determination proposing to grant conditional authorisation to the Proposed Conduct.
