Australia New Zealand Industrial Gas Association (ANZIGA)

On 21 May 2020, the Australia New Zealand Industrial Gas Association (ANZIGA) applied for authorisation on behalf of itself, its members and their related bodies corporate and other suppliers of medical oxygen to hospitals and similar medical facilities in Australia (the Parties) to enable them to exchange information and make and give effect to contracts, arrangements and understandings to ensure security of supply of medical oxygen to hospitals and similar medical facilities during the COVID‑19 pandemic (the Proposed Conduct).

ANZIGA also requested interim authorisation on an urgent basis to ensure that the Parties are able to respond immediately to any significant supply constraint or demand increase for medical oxygen, in the event that this becomes necessary.

On 9 June 2020, the ACCC granted interim authorisation. Further detail on the ACCC’s decision is in the Interim Authorisation Decision document, linked below.

On 2 September 2020, the ACCC issued a draft determination proposing to grant conditional authorisation to the Proposed Conduct. Further detail on the ACCC’s draft determination is in the Draft Determination Decision document, linked below.

On 1 October 2020, the ACCC decided to grant conditional authorisation until 30 September 2021. Authorisation is subject to conditions which require ANZIGA to notify the ACCC before engaging in the Proposed Conduct, regularly report to the ACCC and provide information to the ACCC upon request.
