Description of Conduct

LGA Procurement on behalf of itself, 64 local government councils and 7 associated local government entities in South Australia (together, the Participating Entities) sought authorisation to pool their electricity demand, and jointly investigate and evaluate tenders for the supply of retail electricity services (including Accredited Renewable Electricity and Unspecified Electricity) to the Participating Entities.

LGA Procurement sought authorisation for 15 years.

On 24 May 2022 the ACCC granted interim authorisation to LGA Procurement, to enable it to issue the request for tender to the market for the Proposed Conduct to facilitate the tender process and the negotiation of the terms and conditions of the electricity supply agreement/s. LGA Procurement will not award the tender unless and until final authorisation is granted.

On 9 August 2022, the ACCC issued a draft determination proposing to grant authorisation for a period of 15 years.

On 30 September 2022, the ACCC issued a final determination granting authorisation until 22 October 2037.
