Exemption for Locality Planning Energy Pty Ltd

On 19 May 2023, the Australian Competition and Consumer Commission (ACCC) granted Locality Planning Energy Pty Ltd (LPE) an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) from its consumer data sharing obligations. It is a condition of the exemption that LPE notify the ACCC in writing, as soon as practicable, of any of the following events occurring: (1) LPE reaches 10,000 small customers, or (2) LPE makes an application to become an accredited person. It is also a condition of the exemption that LPE provides a notification to the ACCC if it wishes Part 4 of the Competition and Consumer (Consumer Data Right) Rules 2020 to apply to it on and from a specified date. The ACCC granted the exemption in response to an application from LPE.
