Consumers are reminded that they have until 30 June 1999 to make a claim for a partial refund for calls made to CDRC's Financial Network.

To do so, consumers who called CDRC's Financial Network between January and August 1999 seeking a loan must submit details of their telephone account in writing to the Melbourne office of the Australian Competition and Consumer Commission by 30 June 1999.

Between January and August 1998 CDRC's Financial Network operated four 1902 premium toll numbers charging consumers $5 per minute to inquire about or apply for a personal loan. CDRC advertised its 'loan' service widely in local and regional newspapers around Australia.

It was alleged by the ACCC that advertisements promoting the services of CDRC' s Financial Network were misleading and deceptive by representing that personal loans were available to callers from the operator of the 1902 number cited, or alternatively that the operator arranged loans on behalf of callers.

On 16 September 1998 the proprietor of CDRC's Financial Services, Mr Cedric Collinson, consented to orders in the Federal Court in Melbourne restraining him or any legal entity with which he is associated, from engaging in such conduct as alleged or similar conduct in the future. Mr Collinson also agreed to relinquish a sum of money that had been preserved by the court as part of the ACCC's proceedings.

Consumers wishing to make a claim are reminded they will need to provide proof of payment of calls made to CDRC's Financial network. In the event they have misplaced their original telephone account their telecommunications carrier can provide a duplicate. Consumers should note, however, that their carrier may charge a fee for supplying a duplicate account. Where consumers have not paid their account, by making a claim their liability to the carrier will be reduced by the same amount they would have otherwise been refunded.

To claim a partial refund or partial reduction of telephone account liability consumers must write to the Regional Director, Australian Competition and Consumer Commission, PO Box 52OJ, Melbourne, Victoria, 3001 by 30 June 1999. They should include a copy of their telephone account showing the calls made to CDRC's Financial Network and proof of payment in the event the account has been paid.
