The Australian Competition and Consumer Commission has withdrawn charges of contempt of court against Peter O'Brien.

Mr O'Brien is the sole director of Sensaslim Australia Pty Ltd, which is in liquidation.

On 29 July 2011, the ACCC instituted contempt proceedings against Mr O'Brien alleging that he authored or authorised a communication sent to franchisees of Sensaslim Australia Pty Ltd which had a tendency to interfere with the administration of justice.

On 30 September 2011, the ACCC commenced second contempt proceedings against Mr O'Brien. The ACCC alleged Mr O'Brien authored or authorised communications sent on 13 August 2011 and 16 August 2011 that had a tendency to interfere with the administration of justice.

Since instituting proceedings, the ACCC has acquired further information which indicates that parties other than Mr O'Brien were involved in the alleged conduct.  Therefore the charges against Mr O'Brien have been withdrawn.

The ACCC's proceedings alleging that Sensaslim Australia Pty Ltd (in liquidation) and several individuals involved in the Sensaslim business engaged in misleading and deceptive conduct and made false representations are continuing in the Federal Court.
