The Australian Competition and Consumer Commission has instituted Federal Court criminal proceedings against Camile Trading Pty Ltd trading as Marina Forrestville and Truckstop 31 Pty Ltd for alleged breaches of misleading and deceptive conduct provisions of the Trade Practices Act.

The ACCC has alleged that between January and August 1997 in NSW the companies, on three separate occasions, represented fuel as diesel or distillate when in fact it was not diesel or distillate.

The ACCC also is seeking injunctions against each company to prevent them from offering for sale, or representing, fuel to be diesel when it is not diesel or distillate.

The matter was today transferred from the Federal Court , Canberra to the Federal Court, Sydney with the agreement of all parties.
