The ACCC proposes to revoke authorisation A91264 and grant authorisation AA1000559 in substitution to enable the Reserve Bank Health Society (RBHS) to continue to engage another health insurer, Peoplecare Health Limited (Peoplecare), to provide a range of administrative, operational and management services.

RBHS is a small not-for-profit restricted access provider of private health insurance established by the Reserve Bank of Australia (RBA) in 1959. Peoplecare is an open, not-for-profit provider of private health insurance. They have sought authorisation because they are competitors in the provision of health insurance, and therefore an agreement of this type between them may breach competition laws.

On 25 August 2011 the ACCC granted authorisation to the RBHS for Peoplecare to provide a range of similar services for 10 years. Authorisation A91264 is due to expire on 15 September 2021.

The ACCC proposes to grant re-authorisation for 10 years. The ACCC now invites submissions in relation to this draft determination by 30 August 2021, before making its final decision.

The ACCC also granted interim authorisation on 16 August 2021 for the Conduct to continue while the ACCC assesses the application for re-authorisation.
