On 8 June 2022, the ACCC granted interim authorisation to Virgin Australia Regional Airlines Pty Ltd, Virgin Australia Airlines Pty Ltd, Alliance Airlines Pty Limited and Alliance Aviation Services Limited (together, the Applicants) to enter into and give effect to an extension of their Charter Alliance Agreement.

In their substantive application, the Applicants seek authorisation for five years to enter into and give effect to an extension of the Charter Alliance Agreement, which provides for the joint tender and supply of services to corporate customers, principally for fly-in fly-out employees.

Interim authorisation is granted to enable the Applicants to continue to give effect to the agreement which is the subject of existing authorisations that expire on 9 June 2022.

Interim authorisation protects the arrangements from legal action under the relevant provisions in the Act while the ACCC considers the merits of the substantive application for authorisation.

Having granted interim authorisation, the ACCC is seeking feedback on the substantive application for authorisation. Further information about the ACCC's interim authorisation and the substantive application for authorisation is available on the ACCC’s public register.
