United Petroleum Pty Ltd proposed to acquire the following petrol retail sites from Freedom Fuels Australia Pty Ltd - Kew, Mt Waverley, Churchill, Maffra, Newborough, Tyers and San Remo.

Initially, four other Freedom Fuel sites were included as part of this review, namely Warragul, Morwell, Traralgon and Sale. At the time of making its decision with respect to this matter, the ACCC had not yet made a decision in relation to those sites and is continuing to review United's proposed acquisition of those sites. The ACCC considered the competitive effects of the proposed acquisition in the context of local retail markets for the supply of petrol, diesel and LPG.

Competition analysis

The ACCC formed the view that United's proposed acquisition of Freedom's sites in Kew, Mt Waverley, Churchill, Maffra, Newborough, Tyers and San Remo was unlikely to substantially lessen competition in the relevant markets because United is not currently operating in any of the local markets in which the Freedom sites are located.
