Competition analysis

On the 2 November 2007, the ACCC decided not to oppose the acquisition by Transpacific of the business and assets of Earthpower.

The ACCC considered the information provided by Transpacific and other information available to it. Based on that information, the ACCC did not consider that the acquisition would result in a substiantial lessening of competition in the relevant markets. The main factors that informed this view included that:

* it was unlikely that the acquisition by Transpacific of Earthpower's relatively small-scale business and operations would result in the removal of a significant source of competitive constraint in the relevant markets;
* it was unlikely that Transpacific had the incentive or ability to foreclose the supply of waste collection and transport services in the NSW region to rivals in the waste disposal industry (i.e. landfill operators); and
* it was unlikely that Transpacific had the incentive or ability to foreclose the supply of waste disposal services in the NSW region to rivals in the waste collection industry (i.e. waste collection operators).
