The ACCC considered the following markets in its review of Ausfuel's proposed acquisition:

Competition analysis

The ACCC considered that Ausfuel faces sufficient competitive constraints post-acquisition and that the acquisition is unlikely to cause a substantial lessening of competition in any of the relevant markets. This conclusion was informed by the following factors:

- Barriers to entry into fuel retail markets can be overcome;
- Post-acquisition, there would remain alternative competitive suppliers in the relevant fuel retail markets;
- Barriers to entry and expansion into the Northern Territory fuel distribution market do not appear high;
- Post-acquisition, there would remain alternative competitive distributors that large and small to medium commercial customers can purchase fuel from in the Northern Territory; and
- Octagon's relatively limited involvement in fuel retail and distribution in the Northern Territory.
