Final report - DTCS and fixed line services25 Mar 2024

On 25 March 2024, the ACCC released a final inquiry report about the combined declaration inquiry in relation to the following 8 declared services:

  • Domestic transmission capacity service
  • Wholesale line rental
  • Local carriage service
  • Wholesale Asymmetric Digital Subscriber Line (ADSL)
  • Unconditioned local loop service
  • Line sharing service
  • Fixed originating access service
  • Fixed terminating access service

In summary, as outlined in the final inquiry report, the ACCC has decided it will:

  • Extend the declaration of the domestic transmission capacity service for a further 5 years and vary the service description to reflect technological changes since the last declaration inquiry.
  • Extend the declaration of the wholesale line rental, local carriage service and wholesale ADSL service for a further 5 years with no amendments to the service descriptions.
  • Allow the declarations of the unconditioned local loop and line sharing services to expire without making new declarations.
  • Extend the declaration of the fixed originating and terminating access services for a further 5 years and vary the service description to reflect the industry trends towards IP-based interconnection.

The ACCC will release a separate final inquiry report about the declaration inquiry in relation to the domestic mobile terminating access service, due to the complexity of the issues raised in response to the draft report. The ACCC expects to publish this report by June 2024.

The ACCC understands that some stakeholders may wish to provide further submissions relating to the declaration of the mobile terminating access service. To ensure that the ACCC can take these into account, the ACCC asks that any further submissions be provided by no later than 5pm (AEST) Friday 12 April 2024.
