The ACCC has granted interim authorisation to the Transport Workers Union of Australia SA/NT Branch to commence a collective bargaining process between Toll Transport Pty Ltd (Toll) and owner drivers contracted to Toll in the metropolitan Adelaide region. No agreements will be finalised before the ACCC makes a decision on the substantive application.
Interim authorisation protects this collective bargaining process from legal action under the relevant provisions of the Competition and Consumer Act 2010 while the ACCC considers and evaluates the merits of the application. The ACCC may review the interim authorisation at any time. The ACCC’s decision to grant interim authorisation should not be taken to be indicative of whether or not final authorisation will be granted.
