On 13 August 2021 Telstra submitted to the ACCC a proposed variation to the NBN Migration Plan. The proposed variation covers:

  • amendments to the managed disconnection arrangements for services to premises that are multi dwelling unit common areas (including fire and lift telephone services)
  • extension of the timeframe for managed disconnection of premises that are not NBN-serviceable
  • amendments to allow for public and private payphone services to be differentiated in the Migration Plan to enable Telstra to proceed with a national product exit of private payphone services
  • amendments to expand the current authority within Telstra for the reconnection of copper and hybrid fibre coaxial services in accordance with the standard conditions within the Migration Plan.

Telstra’s submission in support of the proposal and a marked-up version of the varied Migration Plan as proposed are available below.

The ACCC was required to consult publicly on the proposal and consider whether the varied Migration Plan complies with the Migration Plan Principles before making a decision on whether or not to approve it. Submissions were due by 21 October 2021.

The ACCC received three submissions, available below.

Under section 577BF(3) of the Telecommunications Act 1997 the ACCC must approve the variation if it is satisfied that the final migration plan as varied complies with the migration plan principle or otherwise refuse to approve the variation.

Telstra advised the ACCC on 24 November 2021 that it would submit a replacement variation proposal following stakeholder feedback received in the ACCC consultation. See the replacement variation that was submitted
