Extension of regulatory forbearance (disconnections of non-serviceable premises)2 May 2019
On 10 April 2019 Telstra requested an extension of regulatory forbearance from existing disconnection requirements for non-serviceable premises.
On 30 May 2018 the ACCC agreed to Telstra’s previous forbearance request for a 150 business day extension to the disconnection date. Telstra is requesting a further extension of 150 business days. This is in response to NBN Co advising Telstra there are approximately 2000 premises subjected to the previous forbearance that are not yet NBN-serviceable.
This proposal means disconnections of services at affected premises will be deferred. Since the NBN has not yet been rolled out to the affected premises, it is not appropriate for Telstra to disconnect the existing legacy services where there is not an NBN service available. The proposed variation will provide additional time for NBN Co to make premises serviceable prior to the commencement of managed disconnections.
On 12 April 2019 the ACCC agreed to Telstra’s request for extension of forbearance on the condition that Telstra submits a formal variation to the Migration Plan as soon as practical. The ACCC will consider the variation in accordance with the Migration Plan principles and consult publicly when Telstra submits the proposed variation.
