Extended COVID-19 Force Majeure Event and deferral of disconnections29 Sep 2021

On 21 September 2021, Telstra notified the ACCC of an extension to its Force Majeure Event under clause 4.5 of the Migration Plan due to the ongoing impacts of the COVID-19 pandemic.

Telstra advised that the ongoing Force Majeure Event is due to COVID-19 impacts that have persisted in NSW and Victoria and prompted further deferrals to managed disconnection arrangements under the Migration Plan.

The ACCC agrees, as advised to Telstra on 1 April 2020, that the COVID-19 pandemic constitutes a Force Majeure Event under the Migration Plan.

Telstra will not contravene the Migration Plan to the extent that the COVID-19 pandemic causes Telstra to delay or fail to perform its obligations under the Migration Plan.

Telstra is required to notify the ACCC as soon as reasonably practicable after the Force Majeure Event has ceased to affect its Migration Plan obligations.
