Disconnection arrangements for premises not NBN serviceable21 Oct 2020

On 15 September 2020, Telstra requested regulatory forbearance from the ACCC to begin implementation of new Managed Disconnection arrangements for premises that are not serviceable by the NBN, in lieu of arrangements set out in clause 15.9 of the Migration Plan. The proposed new arrangements outlined by Telstra have been agreed between Telstra and NBN Co.

The ACCC agreed to Telstra’s request on the condition that a formal variation to the Migration Plan is submitted by Telstra as soon as practical. The ACCC will consider the variation in accordance with the Migration Plan principles and consult publicly when Telstra submits the proposed variation.

On 25 September 2020, Telstra provided an update to the ACCC on the Force Majeure Event due to COVID-19 affecting Migration Plan disconnection arrangements. Telstra advised that certain Managed Disconnection arrangements will continue to be deferred due to this Force Majeure Event and that Telstra and NBN Co have agreed to this.

The ACCC has previously advised Telstra on 27 August 2020 that the Migration Plan will not be contravened to the extent that this Force Majeure Event causes Telstra to delay or fail to perform its obligations under the Plan.
