The ACCC updated the Infrastructure record keeping rule following the public consultation process. The amendments update the list of record keepers required to report under the record keeping rule.

Other minor amendments include the identification of leased infrastructure and infrastructure operated on behalf of third parties.

Publication of record keeping rule data 2013

In February 2011 the ACCC published information about the availability of competitive fibre infrastructure across the country based on information collected under the Infrastructure record keeping rule. The information is in the form of a list of Exchange Service Areas (ESAs) with more than two fibre infrastructure owners present.  The ACCC considered that publishing the information would enhance the transparency of the ACCC when performing its regulatory functions.

In March 2013 the ACCC amended the Infrastructure record keeping rule to update the list of record keepers and seek information on leased infrastructure and infrastructure operated on behalf of third parties.

In July 2013 the ACCC issued a discussion paper as part of its enquiry into the declaration of the domestic transmission capacity service (DTCS). Analysis of the availability of competitive fibre infrastructure forms part of the criteria that the ACCC will consider in forming its draft decision on the future regulation of the DTCS. The ACCC has updated the 2011 data to enable interested stakeholders to make informed submissions to the DTCS regulatory process. The ACCC has also published a subset of information identifying those ESAs where an NBN point of interconnection is located.
