Extension of the inquiry period 23 Sep 2015

On 23 September 2015, the ACCC decided to extend the period for making a new final access determination for the LBAS by 6 months, until 7 April 2016. The ACCC was unable to complete its inquiry within six months of commencing the inquiry.

The ACCC intends to consult on the LBAS final access determination inquiry concurrently with any Superfast Broadband Access Service (SBAS) final access determination inquiry. This will take place after the conclusion of the SBAS declaration inquiry which commenced on 11 September 2014 and is currently ongoing.

The extension of the inquiry will allow the ACCC to commence and undertake an appropriate degree of consultation on the LBAS final access determination.

The ACCC intends to release a discussion paper in 2016.

Extension of the existing LBAS final access determination

The ACCC is also extending the existing LBAS final access determination as it will not be in a position to make a new final access determination prior to its expiration. A copy of the extension instrument can be found on the public register.
