Notice to extend the inquiry period

The ACCC has decided to extend the period to make the superfast broadband access service (SBAS) final access determination for a period of six months, until 19 July 2023.

The ACCC is unable to complete its inquiry within the current decision-making period of 19 January 2023. It considers that additional time is needed to consult on proposals raised in its draft decision on the access determination. The ACCC is seeking submissions on its draft decision by 9 December 2022.

The ACCC intends to publish an exposure draft of the access determination instrument in 2023 before making a final decision. This will give stakeholders an opportunity to comment on the specific price and non-price terms that will apply.

The ACCC anticipates releasing its final decision in 2023.

Extension of existing interim access determination

On 26 October 2022 the ACCC decided to extend its existing interim access determination for the declared SBAS.

The existing interim access determination is due to expire on 31 December 2022. The ACCC has extended this interim access determination as it will not be in a position to make the new SBAS final access determination prior to 31 December 2022.

The new expiry date is taken to be the day immediately before the day on which the final access determination for the SBAS comes into force.
