On 18 December 2008, the ACCC released its draft decision on ARTC's application to vary the undertaking. Drawing on the submissions received in response to the issues paper, the ACCC’s draft decision was to not consent to ARTC's application. The ACCC was of the preliminary view that it was not an appropriate variation given the relevant statutory criteria under subsection 44ZZA(3) of the Act.
