The Australian Rail Track Corporation (ARTC) resubmitted its 2014 Annual Compliance documentation to the ACCC for assessment in September 2016.
ARTC initially submitted its documentation in 2015 while the 2013 Annual Compliance assessment was ongoing. The ACCC’s assessment of the 2013 Annual Compliance documentation was finalised in June 2016. ARTC’s 2014 Annual Compliance documentation submitted in September 2016 takes account of the findings of the 2013 assessment.
On 6 June 2016 the ACCC released its final determination on ARTC's annual compliance submission relating to the 2013 calendar year. The ACCC's final determination document is provided below.
The ACCC has released a draft determination on ARTC's annual compliance submission relating to the 2013 calendar year. Submissions were initially due by 27 November 2015. However, the ACCC has received a number of requests for an extension of time. The ACCC has therefore granted an extension to all stakeholders. The new due date for submissions is 15 January 2016.
Sections 13.3 and 13.5 of the Hunter Valley Access Undertaking (HVAU) require ARTC to prepare options for, and consult in relation to, the development of a positive performance incentive scheme (PPIS).
ARTC published its consultation document in February 2015, inviting stakeholder comments over a six week period. This process closed on 20 March 2015. There was a limited response to ARTC’s consultation process.
