NBN broadband speeds much improved for most, but not all

Competition among internet service providers (ISP) to perform well in the ACCC’s speed tests is delivering good results for fixed-line NBN customers, although some consumers continue to receive substantially slower speeds than typically available to other consumers on the same plan.

This third ACCC Measuring Broadband Australia (MBA) report, prepared for the ACCC by SamKnows, provides new data on the performance of NBN services from major ISPs.

Peering criteria increase transparency in the internet interconnection market

The ACCC says recent developments in the wholesale market for internet interconnection services will boost competition in the supply of internet connectivity and hosted services to corporate and government customers and lead to a better online experience for end-users.

Optus, Telstra, and TPG have recently published the criteria on which they will consider peering with other internet service providers (ISPs), detailing the requirements other providers need to achieve in order to directly interconnect with them on a settlement free basis.

Data economy drives dynamic changes

ACCC Chair Rod Sims discussed the local and global issues in regulating the data economy in a speech delivered in Sydney today.

Mr Sims examined the difficulty regulators face in determining the competition impacts when dynamic data companies merge, consumer issues and how the ACCC is well placed to take enforcement action in relation to data issues.

“One of the key challenges with merger cases in digital markets is predicting the likelihood of future competition between the target and the acquirer,” Mr Sims said.

Telcos on notice about false and misleading advertising

ACCC Chair Rod Sims has put telecommunications companies on notice to ensure their advertising is clear and transparent or face court action from the regulator, including much higher penalties and a warning that the ACCC may bring proceedings against executives who knowingly approve misleading advertisements.

Earlier this year the ACCC began investigating Optus, Vodafone and Telstra’s use of the term ‘unlimited’ to promote mobile data plans, concurrent with private litigation brought by Optus against Telstra in the Federal Court.

'Congestion-free' claims removed from Aussie Broadband's NBN advertising

NBN provider Aussie Broadband has removed statements across its advertising which described its broadband services as “congestion-free” in response to concerns raised by the ACCC.

Since July 2017, Aussie Broadband claimed that it offered “congestion-free NBN™” and a “congestion-free network”. Aussie Broadband made these statements widely in its advertising, including throughout its website, Facebook posts and advertisements, targeted emails and direct mail-out letters.

Australia's broadband speeds: first report

The ACCC today released the first results from its broadband speed testing program, which show NBN broadband services from iiNet, Optus, Telstra and TPG are now delivering between 80 and just over 90 per cent of the maximum plan speeds in the evening busy hours.

The report, part of the ACCC’s Measuring Broadband Australia program, found these busy hour speeds (between 7 and 11pm) are now only marginally below typical speeds at other times.
